These Terms of Use govern access to and use of the Sanctumel platform (sanctumel.com), including the Sanctumel Pay service. By using our services, you accept these terms unreservedly.

1. Definitions

Sanctumel: Sanctumel SRL, a company incorporated under Belgian law, Rue de la Loi 1, 1000 Brussels, BE0999999999.

Platform: all services accessible via sanctumel.com (Sanctumel Pay, Sanctumel Suite, Community app).

Church: professional user (religious body, worship association, parish, community) accessing the Platform via Pay (free) or a Sanctumel Suite subscription.

Donor: natural person making a donation via Sanctumel Pay.

Sanctumel Pay: free service allowing a Church to receive online donations via Stripe (cards) and Mobile Money (CinetPay/Flutterwave). No subscription required.

Sanctumel Suite: optional subscription (Standard, Premium, Multi-Church plans) giving access to full Church management (members, events, accounting…) AND a reduced Pay commission.

Pay commission: percentage deducted by Sanctumel on each completed donation, via Stripe's application_fee mechanism. 3.50% default without Sanctumel Suite subscription, reduced rate with subscription.

2. Purpose

Sanctumel provides a church management platform and a donation collection service. Sanctumel is not a financial institution and does not perform any e-money operations: transactions are operated by licensed payment providers (Stripe Payments Europe Ltd., CinetPay, Flutterwave).

3. Subscription and access

Access to the platform requires creating an account. The user guarantees the accuracy of the information provided and undertakes to keep it up to date.

Sanctumel reserves the right to refuse, suspend or terminate any account in case of non-compliance with these Terms, breach of legal obligations, or fraudulent use.

4. Pricing and billing

Sanctumel Pay (standalone): entirely free. No subscription, no signup fee, no minimum commitment. A single 3.50% commission is deducted from each completed donation, automatically via Stripe's application_fee mechanism. This commission compensates Sanctumel for providing the platform.

Sanctumel Suite plans (optional): for Churches wanting full management (members, events, accounting, communication, streaming…), three subscription plans are offered:
· Standard - for local Churches. Includes Sanctumel Pay with reduced commission.
· Premium - for growing Churches. Includes Standard + even lower Pay commission + advanced accounting + streaming.
· Multi-Church - for networks and federations. Includes Premium + best Pay rate + multi-campus + API + dedicated account manager.

Payment provider fees: Stripe (cards), CinetPay and Flutterwave (Africa Mobile Money) charge their own fees, deducted directly from the gross amount. Sanctumel does not intervene in these fees and is not responsible for them. Indicative Stripe fees: 1.5% + €0.25 (EU cards), 2.9% + €0.30 (non-EU cards).

VAT: Sanctumel Suite subscription invoices are issued VAT included according to the regime applicable to the Church (intra-EU B2B reverse charge, or Belgian VAT 21% for Belgium). The Pay commission (3.50%) is not subject to separate VAT (service fee integrated into the payment).

Refund: no refund of past Sanctumel Suite subscriptions is due, except as provided by law (B2C withdrawal within 14 days). Pay commission on a donation refunded to the donor via Stripe is also refunded to the Church per Stripe's terms.

5. Church obligations

The Church undertakes to comply with the legislation applicable to its activity (associative status, taxation, financial transparency of donations, pastoral professional secrecy).

The Church is solely responsible for issuing tax receipts to its donors and for their compliance with its jurisdiction.

The Church shall not use the platform for unlawful, fraudulent activities, or contrary to public order and morality.

The Church undertakes to provide its donors with a privacy policy compliant with GDPR and to collect their explicit consent.

6. Donor obligations

The donation is voluntary and irrevocable once confirmed by the payment provider. No direct material consideration is due to the donor, in accordance with the disinterested nature of the donation.

The donor declares that the funds paid come from a lawful source. They are subject to AML legislation in case of false declaration.

In case of manifest error (double payment, incorrect amount), the donor may request a refund via support@sanctumel.com within 30 days.

7. Intellectual property

Sanctumel remains the exclusive owner of the platform, source code, trademarks, logos, designs and content. Any unauthorized reproduction, copying, or use is strictly prohibited.

The Church retains ownership of the data it enters (members, events, transactions). Sanctumel acts as a data processor within the meaning of GDPR.

8. Availability and SLA

Sanctumel strives to maintain 99.5% availability over a rolling year (excluding planned maintenance announced with 48h notice).

Sanctumel cannot be held liable for interruptions due to force majeure, cyber attacks, or provider failures (Stripe, OVH, etc.).

9. Limitation of liability

Sanctumel cannot be held liable for indirect damages (loss of opportunity, image damage, loss of revenue).

Sanctumel's total cumulative liability towards a Church is capped at the amount paid by that Church over the past 12 months.

This limitation does not apply in case of gross negligence, fraud, or violation of mandatory legislation.

10. Personal data

Personal data processing is governed by the Privacy Policy and an annexed Data Processing Agreement (DPA).

Sanctumel acts as a data processor for the data of the Church's members and donors. The Church remains the data controller.

11. Termination

The Church may terminate its subscription at any time from its dashboard. Termination takes effect at the end of the current period.

Sanctumel may terminate the contract with 30 days notice, or immediately in case of serious breach.

Upon termination, the Church has 90 days to export its data. After that, data will be deleted (subject to legal retention obligations).

12. Changes to the Terms

Sanctumel may modify the Terms at any time. Substantial changes are notified by email with 30 days notice. Continued use of the service after this period constitutes acceptance.

13. Applicable law and jurisdiction

These Terms are governed by Belgian law. Any dispute shall be submitted to the courts of Brussels, unless otherwise required by mandatory provisions (in particular for consumers residing in another EU Member State).

For Canadian users: these Terms do not affect your mandatory rights guaranteed by the Civil Code of Quebec or applicable Canadian federal laws.
